    AN ORDINANCE ADOPTING THE LITTLE TOAD CREEK BREWERY AND DISTILLERY ESTABLISHING A BREWERY AND DISTILLERY AS AN ECONOMIC DEVELOPMENT PROJECT WITHIN AND FOR THE SILVER CITY ARTS AND CULTURAL DISTRICT PURSUANT TO SECTION 5-10-2 B. NMSA 1978 (LOCAL ECONOMIC DEVELOPMENT ACT) AND SECTION 16-21(a) OF THE MUNICIPAL CODE OF THE TOWN OF SILVER CITY, GRANT COUNTY, NEW MEXICO.

    WHEREAS, in Section 16-21 of the Municipal Code, the Town has adopted an Economic Development Plan which provides for investment in projects which are designed to create jobs as well as to promote art and cultural projects which further creates a healthy environment for the furtherance of economic development; and

    WHEREAS, the Little Toad Creek Brewery and Distillery facility is located within the Town’s Arts and Culture District; and

    WHEREAS, the Silver City Town Council finds that the Little Toad Creek LLC is a qualifying entity under LEDA and the Town of Silver City Economic Development Plan; and

    WHEREAS, the Town Council finds that the establishment of the Little Toad Creek Brewery and Distillery facility is a worthy project in that it will contribute to the available employment and generally enhance the Town’s downtown neighborhood; and

    WHEREAS, the Town Council finds that the Little Toad Creek Brewery and Distillery facility Project will be beneficial to the Town as a whole by fostering economic development and revitalization of the downtown area; and

     
    WHEREAS, it is the intent of the Town Council that the Town Manager explore all available sources of funding to complete the project, including filing applications and other requests for funding from the New Mexico Economic Development Department, and to commit the Town to agreements that include terms of use, and the securing of appropriate collateral when necessary;


    NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE TOWN OF SILVER CITY, GRANT COUNTY, NEW MEXICO, that:

    1. The Little Toad Creek LLC is a “Qualifying Entity” under State LEDA and the Town of Silver City Local Economic Development Plan; and

    2. The establishment of the Little Toad Creek Brewery and Distillery facility located at 203 E. San Vicente Street, Silver City, New Mexico is formally adopted as an economic development project of the Town; and

    3. The Town Manager is directed to secure funding for the project from any and all available sources, including grants from the New Mexico Economic Development Department; and

    4. The Town Manager is hereby authorized to file necessary applications and to commit the Town to the terms and conditions expressed therein, including where necessary, the securing of appropriate collateral for monies loaned or granted.

    PARA LA ELECCIÓN MUNICIPAL REGULAR QUE SE LLEVARÁ A CABO EL DIÁ 1 DE MARZO DEL 2016

    SEA RESUELTO POR EL CUERPO GOBERNANTE DEL PUEBLO DE SILVER CITY que:
    A. Una elección municipal regular para la elección de oficiales municipales se llevará a cabo el día 1 de Marzo del 2016. Lugares de votación estaran abiertos al público entre las horas de las 7:00 a.m. y las 7:00 p.m.

    B. En la elección municipal regular, individuos serán elegidos para ocupar los siguientes cargos electivos:
    1. Distritos 1, 2, 3 y 4—un Alcalde por un término de dos años.
    2. Distrito 2—un Consejal por un término de dos años.
    3. Distrito 4—un Consejal por un término de dos años.
    C. En acuerdo con NMSA 1978 §3-8-10, los siguientes distritos son consolidados para la elección municipal regular:
    CD01: Consiste de Distritos 1, 2, 3 y 4

Todas las solicitudes para obtener una balota para votar en ausencia deben ser llenadas, y aceptadas por la Escribana de la Municipalidad antes de las 5:00 p.m. el 26 de Febrero del 2016. A partir de las 5:00 p.m. el 26 de Febrero del 2016, la Escribana de la Municipalidad públicamente destruirá todas las balotas no utilizadas. Votación por Anticipado.     FOR THE REGULAR MUNICIPAL ELECTION TO BE HELD MARCH 1, 2016

    BE IT RESOLVED BY THE GOVERNING BODY OF THE TOWN OF SILVER CITY that:
    A. A regular municipal election for the election of municipal officers shall be held on March 1, 2016. Polls will open at 7:00 a.m. and close at 7:00 p.m.

    B. At the regular municipal election, persons shall be elected to fill the following elective offices:
    1. Districts 1, 2, 3 and 4 — One Mayor for a two-year term.
    2. District 2 — One Councilor for a two-year term.
    3. District 4 — One Councilor for a two-year term.
    C. In accordance with NMSA 1978 §3-8-10, the following districts are consolidated for the regular municipal election:
    CD01: Consists of Districts 1, 2, 3, and 4
    D. Districts are consolidated and the following location is designated as the polling place for the conduct of the regular municipal election on March 1, 2016: Silver City Woman’s Club, 411 Silver Heights Blvd., Silver City, New Mexico

    E. Absentee Voting.
    Applications for absentee ballots may be obtained only from the office of the Municipal Clerk at City Hall, 101 West Broadway, Silver City, New Mexico. All applications for an absentee ballot must be completed and accepted by the Municipal Clerk prior to 5:00 p.m., February 26, 2016. After 5:00 p.m. on February 26, 2016, all unused absentee ballots will be publicly destroyed by the Municipal Clerk. The Municipal Clerk will accept completed absentee ballots delivered by mail, or in person by the voter casting the absentee ballot, by a member of the voter’s immediate family, or by the caregiver to the voter, until 7:00 p.m. on March 1, 2016.
    Absentee ballots may be marked in person in the Office of the Municipal Clerk during the regular hours and days of business, beginning on Tuesday, January 26, 2016 and closing at 5:00 p.m. on Friday, February 26, 2016.

    Early Voting. Early voting on paper ballots counted by Dominion electronic tabulators will be conducted in the office of the Municipal Clerk during the regular hours and days of business, beginning on Wednesday, February 10, 2016 and closing at 5:00 p.m. on Friday, February 26, 2016.

    F. Persons desiring to register to vote at the regular municipal election must register with the County Clerk of Grant County not later than Tuesday, February 2, 2016 at 5:00 p.m., the date on which the County Clerk will close registration books.

    G. All Declarations of Candidacy shall be filed with the Municipal Clerk on Tuesday, January 5, 2016 between the hours of 8:00 a.m. and 5:00 p.m.

    H. The casting of votes by qualified municipal electors on March 1, 2016 shall be recorded on paper ballots to be counted by Dominion electronic tabulators.

    Funding is authorized through guidelines stated in Town Ordinance No. 961.     Applicants must reside in Grant County and have an active interest in the management, care and maintenance of Memory Lane Cemetery. The Board meets on the fourth Wednesday of each month at 1:30 p.m.  The terms are for 2 years.
